Abstract: Plea Bargaining has taken a momentum in Criminal Justice and Restorative Justice around the world. India took an initiative to amend the criminal laws to add the provisions related to Plea bargaining in the Criminal Procedure Code through Amendment Act of 2005 in 2006 on the recommendations of the Law Commission report of 1996. Present Article provides the insight of Plea Bargaining and basics of restorative justice with special reference to Plea Bargaining. Article explains concept of Plea Bargaining and focuses on the need of India to better implement it based on following quote- “How can justice be found in the face of genocide, a crime so vast and evil that it defies simple justice? Is there any justice beyond retribution and revenge? Must some kind of justice be done before healing can take place? Something different has to be invented, a different way of defining justice, a different way of dispensing it." – Jane Ciabattari1
